Emergency Guardianship in Michigan
When an Emergency Guardianship Applies
A child lands on your doorstep because a parent was arrested, hospitalized, or simply disappeared. The school needs someone authorized to make decisions by Monday. A doctor won't proceed with treatment without a legal caregiver's consent. These are the situations where Michigan's emergency guardianship process exists.
Under MCL 700.5213, the probate court can appoint a temporary guardian of a minor when there is reason to believe the child's health or safety requires immediate protection. This is an expedited track, and the court may use an expedited hearing or notice process; timing depends on the court and case.
The Legal Standard
To get a temporary guardianship order, you must show the court that the child faces an immediate risk if no guardian is appointed right away. The statute requires that the welfare of the minor requires immediate action. Practically, this means situations like:
- A parent's sudden incarceration with no other legal caregiver available
- A parent's emergency hospitalization or entry into substance abuse treatment
- A child who needs urgent medical care and no one has authority to consent
- A parent who has disappeared and left the child with no legal caretaker
The court doesn't need to find that the parents are unfit forever — just that the child's current situation requires someone to have legal authority immediately.
How to File
The filing process uses the same probate court that handles standard guardianships. You'll need:
- Petition for full or limited guardianship (PC 651 or PC 650) — MCL 700.5213 allows a temporary appointment after the underlying petition is filed; ask the probate court how to request it
- Information showing the immediate need for temporary appointment to protect the child's health, safety, or welfare
- Acceptance of Appointment (PC 571) — signed by the proposed guardian
- The other required packet forms — PC 670, MC 97, DHS-1929, and any local background-check release; for limited guardianship, include PC 652 signed by all custodial parents and the proposed guardian
- Filing fee of $175 for the underlying petition, or a fee waiver request (MC 20) if you qualify based on income or public assistance

What Happens at the Hearing
Under MCL 700.5213, the court may make a temporary appointment ex parte or on expedited notice when an immediate need is shown. The ordinary notice periods are at least 7 days for personal service or 14 days for mail, but ask the probate court how notice applies to an emergency request.
At the hearing, be prepared to explain specifically what happened, why the child cannot safely remain without a legal guardian, and what arrangements you've made for the child's care. Bring any documentation that supports the emergency — hospital records, police reports, school communications asking for legal authority, or letters from doctors.
The Six-Month Cap
Michigan law caps temporary guardianship at six months. This is a hard statutory limit under MCL 700.5213. A temporary appointment may remain in effect for up to six months while the full or limited guardianship petition is pending. It does not replace the court's decision on that petition; continue the underlying case before the temporary authority ends.
Because a temporary appointment follows a full or limited guardianship petition, continue that underlying case toward a final hearing. The temporary order provides authority while the court considers the full or limited guardianship request.
After the Temporary Order
Once the court grants a temporary guardianship, you receive Letters of Guardianship (PC 570) — the official document that proves your authority to schools, doctors, insurance companies, and government agencies. Keep certified copies accessible. Schools typically need one for enrollment, and medical providers may want to see it before proceeding with non-emergency care.
During the case, the court may require background clearances or an investigation as part of deciding the underlying guardianship petition. Cooperate with the court's instructions promptly.
