How to Appeal a Delaware DSS Benefits Denial at a Fair Hearing
Getting a denial letter from Delaware's Division of Social Services feels like hitting a wall, especially when you're raising a grandchild who depends on those benefits. But a denial is not final. Delaware law gives you the right to challenge it through a fair hearing, and if you act quickly enough, your existing benefits can continue while the appeal is decided.
Your Right to a Fair Hearing
Under DSSM 5000 and 5300 regulations, whenever DSS or DMMA denies, reduces, suspends, or terminates a benefit — TANF, SNAP, Medicaid, or childcare — you have the right to request an administrative fair hearing. The agency must send you an "Adequate and Timely Notice" at least 10 calendar days before any adverse action takes effect.
The 10-Day and 90-Day Deadlines
Two deadlines matter:
- 10 days from the notice: If you submit your hearing request within this window (before the adverse action takes effect), your benefits continue unchanged — "aid paid pending" — while the appeal is decided. If the hearing officer eventually rules against you, the state may seek repayment of benefits issued during the appeal period.
- 90 days from the action's effective date: This is the general deadline for requesting a fair hearing. After 90 days, you lose the right to appeal that specific action.
Acting within 10 days gives you the strongest position because the child's benefits stay in place.
How to Request a Hearing
You can file a fair hearing request in three ways:
- By email: send your request to [email protected]
- In writing: submit a written request at any State Service Center or mail it to the Fair Hearing Unit
- Orally: call your local DSS or DMMA office and request a hearing by phone
Include your name, case number, the benefit that was denied or reduced, and a brief explanation of why you believe the decision was wrong.

Preparing for the Hearing
You have the right to inspect and copy any records the state plans to use at your hearing, at no charge. Review the denial notice carefully — it should state the specific regulation or policy section that DSS relied on. For kinship caregivers, common denial reasons include income miscalculation (especially when the caseworker counted the caregiver's income for a child-only TANF grant) and missing documentation.
Free Legal Help
If you're facing a hearing, you don't have to go alone. Community Legal Aid Society (CLASI) and Legal Services Corporation of Delaware provide free representation in benefit appeal cases for low-income families.
For urgent Medicaid managed care issues involving serious health risks, request an expedited hearing — the agency must resolve it within 3 business days.
