Arkansas McKinney-Vento Enrollment for Children Living with Relatives
A child shows up at your door because their parent lost the apartment, went to jail, or entered treatment. You need to get the child into school but you don't have a birth certificate, immunization records, or any custody paperwork. Under normal enrollment rules, you'd be stuck. But the McKinney-Vento Homeless Assistance Act exists for exactly this kind of situation.
What McKinney-Vento Covers
The McKinney-Vento Homeless Assistance Act (42 U.S.C. §11431) is a federal law that protects children who lack a fixed, regular, and adequate nighttime residence. "Doubled up" — sharing another person's housing due to loss of housing, economic hardship, or a similar reason — is explicitly included when the child meets that standard.
Kinship care alone doesn't automatically qualify a child. The move must relate to loss of housing, economic hardship, or a similar reason, and an individualized assessment must find that the child lacks a fixed, regular, and adequate nighttime residence.
What the School Must Do
When a child qualifies under McKinney-Vento, the school district is required to:
- Enroll the child immediately — even without birth certificates, immunization records, school transcripts, or custody papers
- Keep the child in their school of origin if that's in the child's best interest, including arranging transportation across district lines
- Connect you with the district's McKinney-Vento Homeless Liaison — every Arkansas school district has one by federal mandate
The liaison's job is to remove enrollment barriers. They can help you obtain missing records, connect you with free lunch programs, and resolve disputes if the school resists.
How to Request McKinney-Vento Enrollment
- Go to the school's registration office and state that the child is living with you due to a family housing crisis
- Ask to be connected with the district's McKinney-Vento Homeless Liaison
- The liaison will do an individualized assessment to determine if the child qualifies
- If the child qualifies, enrollment happens that day — missing documents are gathered afterward
The standard is about the child's nighttime residence, not whether anyone is literally on the street. A child sleeping on your couch after the parent's house was condemned, or staying with you after an eviction, may qualify if the living arrangement is not fixed, regular, and adequate.

McKinney-Vento Plus In Loco Parentis
McKinney-Vento gets the child into school fast when records are missing. For ongoing enrollment — signing permission slips, getting report cards, attending parent-teacher conferences — your authority comes from in loco parentis standing under Arkansas Code §6-18-202(a)(1) and (b)(1)(A). The two work together: McKinney-Vento removes the initial barriers, and in loco parentis gives you the ongoing parental-equivalent authority the school needs.
Medical Consent Too
The McKinney-Vento liaison also has authority under §20-9-602(14) to consent to medical care when the child meets the Act's homeless definition, is not in a parent's or guardian's care or custody, and is not in DHS custody. But if the child is living with you, you may have your own consent authority — as a grandparent under §20-9-602(9), as a sibling under §20-9-602(8), or as an in loco parentis caregiver under §20-9-602(5).
Finding Your District's Liaison
The Arkansas Division of Elementary and Secondary Education (DESE) maintains a directory of McKinney-Vento liaisons. You can also call the school's main office and ask for the liaison by title — every district is required to have one.
The Complete Enrollment Process
McKinney-Vento is one pathway into school. The School and Medical Consent Guide for Arkansas covers all of them — McKinney-Vento, in loco parentis, and POA-based enrollment — along with the medical consent authority you'll need for doctor visits once the child is settled.
