Alberta Guardianship Forms: FL-10, FL-34, and the Complete Filing Package
You've decided to apply for guardianship of a child in your care, and now you're staring at the Alberta Courts website trying to figure out which forms to download. The site lists dozens of family law forms with cryptic codes, and nothing tells you which combination you actually need.
Here's the exact form package for a non-parent guardianship application under Alberta's Family Law Act.
The Core Forms You Must File
Form FL-10 (Claim – Family Law Act) is your initiating document. It names the parties, identifies the child, and states the guardianship relief you're requesting. This is the form that officially starts your court case.
Form FL-34 (Adult's Statement – Guardianship of Child) is where you make your case. This sworn statement covers your care history with the child (an adult applicant generally needs more than six months of care and control, unless the court waives that requirement under Section 23(5)), your living situation, the child's needs, and why you're a suitable guardian. Expect to attach supporting documents as exhibits — things like school records, medical letters, or proof of your caregiving arrangement.
Form FL-35 (Child's Statement – Guardianship of Child) applies when the child is 12 years or older. The child can use this form to express their views and preferences about the proposed guardianship directly to the judge.
In the Court of King's Bench Regular Family Process, FL-10 starts the action and is served first. The later MIT package includes Form FL-18 and, if relief is sought, supporting statements such as FL-34.
Forms for the Respondent
After they receive the claim and supporting application materials, parents may respond with:
- Form FL-11 (Response – Family Law Act) — The parent's formal reply to your claim.
- Form FL-57 (Reply to Adult's Statement – Guardianship) — A sworn counter-statement responding to the specific allegations in your FL-34.
You don't fill these out — the parent does. But knowing they exist helps you understand what might come back after service.
Proof of Service and Exemption Forms
Affidavit of Service (Form CTS3513) — After service, the person who served the documents completes this sworn form confirming the date, time, and address. Court instructions allow service by you, a friend, or a process server. In the Court of King's Bench Regular Family Process, file proof of service for the commencement document and again for the later MIT package.
Waiver of King's Bench Family Justice Strategy requirements — The current process uses Form CTS13474 (Request to Waive/Defer), Form KB233 (Desk Application), and Form KB234 (Notice to Respond). Serve the request and notice with Form KB235 (Response to Request), allow the respondent five clear days, then file the required documents. Court of Justice waiver procedures are separate.

Where to Download These Forms
All forms are free from the Alberta Courts website. The Court of King's Bench forms are available at albertacourts.ca under Family Law Forms, and the Alberta Court of Justice forms are listed under Family and Youth Practice Directions and Forms. Both courts provide fillable PDF versions.
RCAS (Resolution and Court Administration Services) also provides free Court Forms Information Coordinators who can help you understand which fields to complete. They cannot fill forms out for you or give legal advice, but they can clarify procedural questions about the paperwork.
Filing Location and Fees
You can file your FL-10 at either court:
- Alberta Court of Justice — No filing fee. Preferred by many self-represented applicants for its accessible intake support.
- Court of King's Bench — $100 filing fee. Use King's Bench when the guardianship is intertwined with an ongoing contested divorce or family-property action between the child's parents.
If the $100 fee is a barrier, apply for a Fee Waiver with a sworn Financial Statement before or at the time you submit your FL-10.
Getting the Forms Right
The most common filing delays come from incomplete FL-34 statements — missing care dates, unsigned affidavits, or exhibits that aren't properly referenced. The Alberta Private Guardianship Court Process Guide includes a document assembly checklist that walks through every field and exhibit for each form in the package.
