Does a Power of Attorney Have to Be Notarized in Alabama?

What the Statute Says vs. What Actually Happens

Alabama Code § 26-2A-7 requires a "properly executed power of attorney" for delegating parental authority over a child. The statute itself doesn't contain the word "notarized." It says the parent must sign a written instrument delegating specific powers — health, education, maintenance, and support — for up to twelve months.

In practice, every school, pediatrician, hospital, and pharmacy in Alabama will reject an unnotarized POA. That's because notarization serves two purposes these institutions care about: it confirms the parent's identity and it establishes that the delegation was voluntary. Without the notary seal, the front desk has no way to verify the signature, and their legal department won't accept the liability risk.

So the short answer: legally, the statute doesn't explicitly mandate notarization. Practically, you need it notarized or you're going to be turned away.

Where to Get a POA Notarized

Notary services are available at:

  • Banks and credit unions — most offer free notarization for account holders
  • UPS Store locations — typically $5 to $15 per signature
  • County probate court offices — some Alabama counties provide notary services at the courthouse
  • Legal aid offices — Legal Services Alabama may notarize documents during intake appointments
  • Libraries and community centers — some offer periodic free notary events

Both the parent and the notary need to be present at the time of signing. The parent must bring a valid photo ID. The caregiver (attorney-in-fact) does not need to be present for notarization, though it's simpler if they are.

Notarization When a Parent Is Incarcerated

If the parent is in an Alabama jail or prison, they can still execute a POA. Correctional facilities have notary services, though scheduling may take time. Contact the facility's social work or legal services department to arrange it. The parent retains full legal capacity to sign as long as they're mentally competent — incarceration doesn't affect their parental rights.

Optional: Recording at the Probate Court

After notarization, you can optionally record the POA at the county probate court. Recording creates a public record of the instrument, which can help if questions arise later about whether the delegation was properly executed.

Recording fees vary by county. Montgomery County Probate Court charges $10.50 for recording a power of attorney. Not every county charges the same amount, so call ahead.

Recording is not required for the POA to be legally valid — a notarized original is sufficient. But having the probate court record on file gives you a backup if the original is lost, and some institutions find a recorded instrument more convincing.

Common Notarization Mistakes

A few things that will get your POA rejected even with a notary stamp:

  • Wrong notary acknowledgment form. The notary needs to use Alabama's acknowledgment format, not a generic or out-of-state form.
  • Expired notary commission. Occasionally happens with mobile notaries. Ask to see their commission expiration date.
  • Missing details in the POA itself. The notarization is only as good as the document. If the POA doesn't name the child, list specific delegated powers, or include start and end dates within the 12-month statutory limit, institutions will reject it regardless of the notary seal.

The Full Paperwork Picture

Notarization is one piece of a larger documentation puzzle for relatives raising a child in Alabama. A notarized POA handles medical consent and school permissions, but it doesn't establish school residency — that requires a separate district affidavit. And it doesn't help if the parent refuses to sign.

The Alabama School and Medical Consent Guide covers the complete paperwork stack: which documents you need, how to execute each one correctly, and what to do when institutions push back.
